Health notice: SleepTonic is a wellness and relaxation tool, not a medical device and not a substitute for professional medical advice, diagnosis, or treatment. Please read the Health & Safety Disclaimer below.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use SleepTonic. If you are a minor, you may use the App only with the involvement and consent of a parent or legal guardian. The optional Kids Mode is intended to be configured and supervised by a parent or guardian.

2. License to Use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use SleepTonic on devices you own or control, for your own personal, non-commercial use. This license is also subject to the applicable App Store / Google Play terms.

3. Restrictions

You agree not to:

• Copy, modify, reverse-engineer, decompile, or disassemble the App, except where permitted by law;
• Rent, lease, lend, sell, redistribute, or sublicense the App;
• Extract, re-record, redistribute, or commercially exploit the App's audio, sounds, or other content;
• Use the App in any unlawful manner or in violation of these Terms or store policies;
• Circumvent, disable, or interfere with security or subscription/entitlement features.

4. Subscriptions, Billing & Cancellation

SleepTonic offers an optional auto-renewing Premium subscription (for example, monthly or annual plans). The following applies to all paid subscriptions:

• Billing: Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Auto-renewal: Subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Managing & cancelling: You can manage or cancel at any time in your App Store account settings (iOS) or Google Play → Subscriptions (Android). Cancellation takes effect at the end of the current billing period.
• Free trial (if offered): Any unused portion of a free trial is forfeited when you purchase a subscription. If a trial is offered, the trial converts to a paid subscription unless cancelled before it ends.
• Refunds: Purchases are processed by Apple or Google and refunds are handled under their policies. We do not directly process payments or issue refunds. For Apple, request refunds at reportaproblem.apple.com; for Google, via the Google Play refund process.
• Price changes: We may change subscription prices. Changes apply to future billing periods and, where required, will be communicated to you in advance with the opportunity to cancel.

Prices and available plans are shown in the App and may vary by region and over time.

5. Health & Safety Disclaimer

SleepTonic plays binaural beats, nature sounds, and ambient audio intended for relaxation and sleep support. Important:

• The App is not a medical device and does not diagnose, treat, cure, or prevent any disease, disorder, or health condition, including insomnia.
• Individual results vary; scientific evidence on binaural beats is mixed and ongoing. We make no guarantee of any specific outcome.
• Consult a qualified healthcare professional before use if you are pregnant, have epilepsy or a seizure disorder, a heart condition, a hearing condition, a mental-health condition, or wear a pacemaker or other medical device.
• Do not use the App while driving, operating machinery, or performing any activity that requires your full attention. The App is intended for use while at rest.
• Hearing safety: listen at a low, comfortable volume. Prolonged exposure to loud audio, especially through headphones, can damage your hearing.
• Always seek the advice of a physician with any questions about a medical condition. Never disregard or delay professional medical advice because of something you experienced in the App.

6. Intellectual Property

The App, including its software, audio engine, sound design, recorded loops, design, text, graphics, logos, and the "SleepTonic" name, is owned by MucoApps or its licensors and is protected by intellectual-property laws. Recorded nature and ambient audio is used under royalty-free or Creative Commons licenses (e.g. CC0); all rights in the App as a whole remain with us. No rights are granted to you except the limited license in Section 2.

7. User Content

Any mixes, presets, or settings you create stay on your device and are not uploaded to us. You are responsible for your own configurations. We claim no ownership over your personal arrangements of in-app sounds.

8. Third-Party Services & Stores

Your download and use of the App is also subject to the terms of the store you obtained it from (Apple App Store or Google Play). Apple and Google are not parties to these Terms and are not responsible for the App. Where you obtained the App from the Apple App Store, the "Apple-Required EULA Terms" in Section 13 apply.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL ACHIEVE ANY PARTICULAR SLEEP, RELAXATION, OR HEALTH RESULT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MUCOAPPS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $50, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless MucoApps and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App or your violation of these Terms.

12. Termination

These Terms apply until terminated. Your license ends automatically if you breach them. You may end them at any time by deleting the App. Sections that by their nature should survive (e.g. intellectual property, disclaimers, limitation of liability) survive termination.

13. Apple-Required EULA Terms

If you obtained SleepTonic from the Apple App Store, you acknowledge that: (a) these Terms are between you and MucoApps only, not Apple; (b) Apple has no obligation to provide maintenance or support for the App; (c) in the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; (d) Apple is not responsible for addressing any claims relating to the App or your use of it (including product-liability, legal/regulatory non-conformance, and consumer-protection claims); (e) Apple is not responsible for any third-party intellectual-property claim regarding the App; and (f) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing Law & Disputes

These Terms are governed by the laws applicable in the jurisdiction in which MucoApps is established, without regard to conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence provide otherwise. You may have additional rights under your local consumer laws that these Terms do not override.

15. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date reflects the latest version. Material changes will be brought to your attention in the App or on this page. Continued use of the App after changes take effect constitutes acceptance.
